1.About These Terms

1.1

These Terms of Service ("Terms") govern your use of the website located at thelegacyvault.ca (the "Website"), operated by Barbara Zarzosa ("we", "us", "our").

1.2

By accessing or using the Website, you agree to these Terms. If you do not agree to these Terms, please do not use the Website.

1.3

These Terms apply to all visitors to the Website, whether or not you make a purchase.

2.Relationship to Other Documents

2.1

These Terms govern your use of the Website only.

2.2

Use of The Legacy Vault for Canadians desktop application (the "Application") is governed by a separate End User Licence Agreement, which is presented to you when you install the Application and is also available at thelegacyvault.ca/eula.

2.3

Our collection, use, and disclosure of Personal Information is governed by our Privacy Policy, available at thelegacyvault.ca/privacy.

2.4

In the event of a conflict between these Terms and the End User Licence Agreement with respect to use of the Application, the End User Licence Agreement shall govern.

3.Acceptable Use of the Website

You may use the Website for lawful purposes only. You agree not to:

  • use the Website in any manner that violates applicable laws or regulations;
  • attempt to gain unauthorized access to any portion of the Website, its underlying systems, or any other user's account or information;
  • interfere with, disrupt, or impose an unreasonable load on the Website's operation;
  • use automated tools (including bots, scrapers, or crawlers) to access the Website, except for the purposes of standard search engine indexing in accordance with our robots.txt file;
  • reproduce, distribute, modify, or create derivative works of the Website's content, except as expressly permitted in Section 4.2;
  • impersonate any person, or misrepresent your identity or affiliation in communications with us;
  • use the Website to transmit malicious code, viruses, or any other harmful content;
  • use the Website in any manner that infringes the rights of any third party.

4.Intellectual Property

4.1

All content on the Website — including text, graphics, logos, images, video, audio, software, and the design and layout — is the property of Barbara Zarzosa or its licensors, and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

4.2

You may view, download, and print Website content for your personal, non-commercial use. All other use, including reproduction, distribution, public display, or use for commercial purposes, requires our prior written permission.

4.3

"The Legacy Vault" and "The Legacy Vault for Canadians", together with the associated logo and design, are trademarks of Barbara Zarzosa. You may not use these trademarks without our written permission.

5.Purchases

5.1

If you purchase the Application through the Website, your purchase is governed by these Terms, the End User Licence Agreement, and any additional terms presented to you at checkout.

5.2

Prices on the Website are in Canadian dollars unless otherwise stated, and may be subject to applicable taxes.

5.3

Payment is processed by our third-party payment processor. We do not store full payment card information.

5.4

By placing an order, you represent that you are of the age of majority in your jurisdiction and authorized to use the payment method provided.

5.5

We reserve the right to refuse or cancel any order at our discretion, including for suspected fraud, payment failure, or other legitimate reasons. If we cancel an order for which payment has already been received, we will issue a refund.

6.Refund Policy

6.1

We offer a thirty (30) day money-back guarantee on purchases of the Application. To request a refund, contact barbara@thelegacyvault.ca within thirty (30) days of the date of purchase.

6.2

Approved refunds will be returned to the original payment method.

6.3

After thirty (30) days from the date of purchase, all sales are final.

Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent any such limitation is held unenforceable, the limitation shall apply to the fullest extent permitted by applicable law.

9.Indemnification

You agree to indemnify, defend, and hold harmless Barbara Zarzosa and its agents and representatives from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your violation of these Terms; (b) your violation of any applicable law; or (c) your infringement of any third-party right.

10.Third-Party Links and Services

10.1

The Website may contain links to third-party websites or include embedded third-party services (for example, the payment processor).

10.2

We are not responsible for the content, products, services, or privacy practices of any third party. Your use of third-party websites and services is at your own risk and is governed by the third party's own terms and policies.

11.Governing Law and Jurisdiction

11.1

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

11.2

You irrevocably agree to submit to the exclusive jurisdiction of the courts of the Province of Ontario for the resolution of any dispute arising out of or related to these Terms or your use of the Website.

12.Consumer Protection

Nothing in these Terms shall be construed to limit or exclude any rights you may have that cannot be waived under applicable consumer protection legislation, including the Ontario Consumer Protection Act, 2002. Where any provision of these Terms conflicts with a non-waivable statutory right, the statutory right shall prevail to the minimum extent necessary.

13.Changes to These Terms

13.1

We may update these Terms from time to time. The Effective Date at the top of these Terms will indicate when they were last revised.

13.2

Material changes will be announced on the Website. Your continued use of the Website after a change constitutes acceptance of the updated Terms.

14.General Provisions

14.1

Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14.2

No Waiver. No failure or delay by us in exercising any right under these Terms shall constitute a waiver of that right.

14.3

Entire Agreement. These Terms, together with the Privacy Policy and, where applicable, the End User Licence Agreement, constitute the entire agreement between you and us with respect to the Website.

14.4

Assignment. You may not assign these Terms. We may assign these Terms at our discretion.

14.5
